Mediation is a non-binding, private process where two parties attempt to negotiate a compromise with the help of a neutral third party. The third party, called a mediator, helps the opposing sides come to a mutually acceptable agreement. In family law, mediation is commonly used to work through divorce, child custody, division of property and debts, and spousal or child support — with a mediator working alongside you and your attorneys to reach a settlement acceptable to everyone. Once everyone agrees and signs a formal document, the terms are usually legally binding.
Mediation is a way for two parties to privately resolve disputes; while the mediator can’t force a decision, a settlement reached in mediation can become legally binding once signed. Arbitration also offers more privacy than a court hearing or trial, but the decision is generally legally binding and can only be appealed in limited, specific circumstances.

Mediation discussions themselves are not binding. However, once you sign a formal agreement based on those discussions, it becomes legally enforceable after court approval as part of your divorce.

Mediation does not require a strong relationship; it requires a willingness to participate. A skilled mediator can help structure conversations and keep discussions focused. However, in cases involving extreme conflict or safety concerns, other legal options may be more appropriate.
Mediation works best when both spouses can negotiate in good faith. It's generally not a good fit in situations involving domestic violence, a significant power imbalance, or hidden assets—since mediation relies on both sides being able to advocate for themselves. In those cases, litigation or working through attorneys directly may offer more protection.
